    THE COST OF GETTING THIS WRONG

    Before we get into the requirements, let's be direct about what's at stake.

    Practicing without a valid PAA — or with a PAA that doesn't meet Texas Board of Nursing (BON) and Texas Medical Board (TMB) standards — isn't a paperwork problem. It's a licensing problem. Both boards have independent enforcement authority, and both can investigate, sanction, and suspend your ability to practice.

    The most common compliance failures Texas NPs face:

    • Lapsed PAA — agreement expired, not re-signed annually, prescribing continued

    • Undocumented chart reviews — percentage met but no written record

    • Missing monthly meeting documentation — meetings happened, nothing was logged

    • Physician at capacity — collaborating with a physician already at the 7-NP limit

    • Schedule II overstep — prescribing outside authorized settings

    Any one of these can trigger a BON or TMB investigation. A license suspension doesn't just pause your practice. It can end it.

    THE PRESCRIPTIVE AUTHORITY AGREEMENT (PAA): WHAT IT MUST INCLUDE

    The PAA is the legal document that defines your prescribing authority in Texas. It must be written, signed by both parties, and retained at your practice site — available for inspection by the BON or TMB at any time.

    A valid Texas PAA must include:

    • Full identification of all parties, including NP and collaborating physician with license numbers

    • Practice settings and locations covering every site where you'll practice under the agreement

    • Scope of delegated prescriptive authority, including authorized drug classes and any prescribing conditions

    • Chart review protocols specifying frequency, percentage, and documentation method

    • Consultation and referral procedures, including escalation for cases outside your scope

    • Communication processes outlining how and when you'll be in contact with your physician

    • A quality assurance plan documenting how oversight will be reviewed

    • Signatures from both parties

    One critical distinction: The NP does not file the PAA with the state. It's the collaborating physician who must register with the TMB before delegation begins. The NP retains the signed PAA at the practice site.

    The PAA must be reviewed and re-signed at least annually. Update it any time your practice scope changes — whether that's new specialties, new locations, or changes to your prescribing needs.

    CONTROLLED SUBSTANCES: WHAT TEXAS NPS CAN AND CANNOT PRESCRIBE

    With a valid PAA, Texas NPs can prescribe Schedule III through V controlled substances, subject to the limitations defined in the agreement.

    Schedule II substances — including opioids and stimulants like Adderall — are more restricted. Texas APRNs may prescribe Schedule II drugs only in limited settings, primarily hospitals and hospice care, under specific conditions outlined in the PAA.

    For any controlled substance prescribing, you also need:

    • An active DEA registration number (federal requirement, separate from the PAA)

    • Compliance with the Texas Prescription Monitoring Program (PMP)

    • For Schedule II refills: consultation with your collaborating physician after the initial 90-day supply, and every 90 days thereafter

    PHYSICIAN RATIO LIMITS AND GEOGRAPHIC FLEXIBILITY

    The 1:7 Cap

    Texas limits each physician to a maximum of 7 full-time equivalent NPs and PAs combined. If your prospective collaborating physician is already at or near capacity, the agreement isn't valid.

    This matters more than most NPs realize. In high-demand specialties and major metro areas, popular collaborating physicians fill up fast. Confirming available capacity before you invest time in a relationship is essential.

    Exceptions apply for:

    • Facility-based hospital practices, where institutional protocols may allow additional providers

    • Medically underserved areas, where the ratio cap may be relaxed to improve access to care

    No Geographic Distance Requirement

    Unlike states that require the collaborating physician to be within a certain number of miles, Texas has no geographic proximity restriction. Your physician can be located anywhere in the state, as long as they remain continuously available for consultation by phone or electronic communication during your practice hours.

    This is a significant advantage for NPs in rural areas and those building independent practices across the state.

    ONGOING COMPLIANCE: CHART REVIEWS, MEETINGS AND DOCUMENTATION

    Signing a PAA is the starting line, not the finish line. Texas requires active, documented oversight throughout the life of the collaborative relationship.

    Chart Reviews

    The PAA must specify a chart review percentage. Ten percent is the widely accepted industry benchmark and what most compliance auditors expect to see documented. Your physician should be reviewing a representative sample of patient charts regularly — not just signing off on a number.

    Each review should document:

    • Date of review

    • Patient charts reviewed (by identifier, HIPAA compliant)

    • Physician comments or recommendations

    • Any follow-up actions required

    Monthly Collaborative Meetings

    Texas requires monthly meetings between the NP and collaborating physician to discuss patient care, treatment protocols, and prescribing concerns. These can be conducted virtually by phone or video, which aligns well with the state's lack of geographic restrictions.

    Meeting documentation should capture:

    • Date and format (phone, video, or in-person)

    • Topics discussed

    • Any changes to the PAA or clinical protocols

    • Attestations from both parties

    Continuous Availability

    Your collaborating physician must be continuously available for consultation during your practice hours. Not physically present, but reachable by phone or electronic communication. This is a patient safety requirement, not just a paperwork one.

    Annual PAA Renewal

    Every PAA must be reviewed and re-signed annually. Use this as an opportunity to update drug formularies, adjust protocols, and make sure the agreement accurately reflects how your practice has evolved. A lapse in your PAA means a lapse in your prescribing authority.

    TELEMEDICINE COLLABORATIONS IN TEXAS

    Texas law permits APRNs to prescribe via telemedicine, provided the prescription is issued for a legitimate medical purpose within a valid patient-practitioner relationship. The same PAA requirements apply, and your agreement should specifically address how chart reviews, consultations, and physician oversight will be conducted in a virtual environment.

    Key considerations for telehealth NPs:

    • Your PAA must list your telehealth platform as a practice setting

    • Chart review protocols should account for virtual visit documentation

    • Monthly meetings with your collaborating physician can be conducted virtually

    • Real-time escalation procedures for urgent clinical needs must be defined in the agreement

    • All communication between you and your collaborating physician must occur on HIPAA-compliant platforms

    Out-of-state APRNs providing telemedicine services to Texas patients must hold an active Texas APRN license and either a Texas RN license or multistate RN privilege.

    WHAT DOES A COLLABORATING PHYSICIAN COST IN TEXAS?

    This is the question every Texas NP asks — and the answer varies more than most people expect.
