    The Cost of Getting This Wrong

    West Virginia's reduced-practice framework creates multiple points of compliance risk. These generate the most serious consequences:

    Prescribing without a filed, board-verified CPA. Prescriptive authority in West Virginia is not activated by executing a collaborative agreement — it is activated when the WV RN Board verifies and files the agreement. An NP who begins prescribing before receiving board confirmation that the agreement has been processed is practicing without legal prescriptive authority. Board action for unauthorized prescribing in West Virginia can include immediate license suspension. The execution date and the authorization date are not the same — plan for processing time.

    Exceeding the Schedule II supply limit. West Virginia law caps Schedule II narcotic prescriptions from NPs at a three-day supply. No collaborative agreement, physician co-signature, or clinical justification can waive this limit. Issuing a Schedule II narcotic prescription for more than three days is a statutory violation regardless of clinical context. This is the single most consequential prescribing restriction West Virginia places on NPs, and it materially affects practices in pain management, surgical follow-up, and addiction medicine. The limit applies to both in-person and telehealth prescribing.

    Missing the notarization requirement. Both your signature and the physician's signature must each be separately notarized on the date the agreement is signed. This is not a general notarization of the document — each party's signature requires its own notarization. A CPA submitted without proper dual notarization will be rejected by the Board, delaying your prescriptive authority approval and potentially forcing you to re-execute the entire agreement.

    Collaborative Practice Agreement (CPA) Content Requirements & Board Filing Process

    West Virginia APRN practice requires a collaborative agreement to obtain and maintain prescriptive authority. Nursing practice itself does not require a CPA — but any prescription authority requires one unless the NP has been granted independent status by the Board.

    Document Requirements. Under West Virginia Code § 30-7-15b, a compliant collaborative agreement is part of advanced practice licensure compliance in West Virginia and must include:

    • Mutually agreed-upon written guidelines or protocols for prescriptive authority relevant to the NP's specific clinical practice setting

    • Clearly defined individual and shared responsibilities for both the NP and the collaborating physician

    • Provisions for periodic, joint evaluation of the NP's prescriptive practice

    • Provisions for periodic, joint review and updating of the written guidelines or protocols

    Periodic joint evaluation of the prescribing practice is a required element of the agreement.

    When these protocols are created, the physician's scope of practice should be similar to the APRN's specialty.

    Execution and Notarization. Both parties must sign the agreement, and each signature must be notarized on the date it is signed. The collaborator must be a licensed physician in good standing in West Virginia. The notarization must occur on the same date the agreement is executed — not before, not after. Plan notarization logistics carefully, especially if your collaborating physician is at a geographic distance.

    The Three-Year Independence Pathway

    West Virginia offers a statutory pathway to independent prescriptive authority that few reduced-practice states provide. After at least three years of documented collaborative practice experience under a duly documented collaborative relationship with granted prescriptive authority, an NP in good standing may apply to the Board for independent prescriptive authority.

    What "duly documented" means. The Board expects substantive records of your collaborative relationship: joint evaluations, protocol reviews, case discussions, and collaborative activities documented at regular intervals throughout the three-year period. A passive arrangement where the physician signed a filed agreement but never participated in meaningful collaboration will not meet the Board's standard. Document every joint evaluation, every protocol review, every case discussion — even brief ones — with date, participants, and summary of discussion.

    Application Requirements. The application requires: evidence of three years of documented collaborative practice, a completed application form, and payment of the required fee for applicants seeking independent prescriptive authority as the next step. The Board retains the authority to mandate return to collaborative status at any time for public protection or licensee rehabilitation purposes — independence is not irrevocable if compliance issues arise.

    What does not change after independence. CSMP registration, DEA registration, PDMP check obligations, the Schedule II three-day supply limit, and electronic prescribing requirements remain fully in effect after independence. Independence eliminates the CPA requirement — it does not eliminate the broader controlled substance compliance framework.

    Controlled Substance Rules

    Schedule I — Prohibited. Even within APRN practice, NPs may not prescribe Schedule I controlled substances under any circumstances.

    Schedule II — NPs may prescribe Schedule II substances, and prescribe medications under a valid collaborative agreement, subject to schedule-specific limits: a maximum three-day supply of Schedule II narcotics. This limit is not adjustable by collaborative agreement or by independence status. Your written CPA protocols must explicitly address Schedule II prescribing within this constraint. The limit applies to both in-person and telehealth prescribing.

    Schedules III–V — No statutory supply limit specified beyond standard prescribing rules.

    Federal DEA Registration — Required for all NPs prescribing controlled substances. Apply through deadiversion.usdoj.gov. Allow 4–6 weeks for new applications. Renews every three years at $888. Address-specific — update with any practice location change.

    State CSMP Registration — West Virginia's Prescription Drug Monitoring Program, the Controlled Substance Monitoring Program (CSMP), requires mandatory registration for all practitioners authorized to prescribe Schedule II–V substances. CSMP registration is a separate credential from your CPA and DEA registration — all three must be active and current.
