The Cost of Getting This Wrong
New Hampshire's freedom from physician oversight does not grant freedom from regulatory liability. These are the highest-risk failure points for New Hampshire NPs.
Prescribing controlled substances without a State CS Registration. Your DEA registration alone does not authorize you to prescribe controlled substances in New Hampshire. You must separately obtain a Controlled Substance Registration (CSR) from the NH Board of Pharmacy. Prescribing without it exposes you to criminal charges under New Hampshire's Controlled Drug Act — not merely a board sanction. This is a separate credential with separate renewal requirements and separate enforcement consequences.
Failing to check the PDMP before initial opioid prescriptions. New Hampshire mandates PDMP checks before issuing any initial Schedule II–IV opioid prescription for pain management. The query must occur before the prescription is written — not after, not simultaneously. A single missed check that contributes to a patient harm event can result in Board of Nursing discipline, civil liability, and DEA action simultaneously. Document every PDMP query in the patient's medical record with date, time, and findings.
Missing the semi-annual PDMP check requirement for ongoing opioid therapy. Patients on ongoing opioid therapy require PDMP re-checks at minimum twice per year. This is a separate obligation from the initial check. Failure to document semi-annual queries is a Board compliance violation independent of clinical outcomes.
Confusing the federal MATE Act training with the state CE requirement. New Hampshire imposes a state-specific requirement of three contact hours of board-approved continuing education in pain management or addiction disorders per renewal cycle. Many NPs aware of the federal MATE Act's 8-hour training mistakenly assume the federal requirement satisfies the state requirement. It does not. You need both — the one-time 8-hour MATE Act training before DEA registration or renewal, and three hours of board-approved state CE per two-year cycle. Failing to complete the state CE can delay license renewal.
Full Practice Authority for Nurse Practitioners: What It Means (And What It Doesn't)
What New Hampshire law permits. New Hampshire grants APRNs full practice authority under RSA 326-B:18. You may evaluate patients, order and interpret diagnostics, diagnose, prescribe medications including controlled substances, provide therapeutic measures, and administer treatment independently within your scope — with no physician co-signature, no supervision mandate, and no consultation requirement imposed by state law.
What governs your practice. In the absence of a physician oversight framework, your practice is governed by your APRN license scope as defined by the NH Board of Nursing, your national certification standards (ANCC, AANP, or equivalent), your state and federal controlled substance registrations, and your DEA compliance obligations. New Hampshire APRNs must also hold an active RN license and complete a graduate degree before APRN licensure. These replace the physician-oversight structure entirely.
What does not change. Your clinical scope remains tied to your certified population focus. Full practice authority does not permit you to practice outside your certification — an Adult-Gerontology Primary Care NP cannot independently manage pediatric patients simply because New Hampshire is a full practice state. Scope violations remain violations, and independence does not excuse them.
Institutional vs. state law. If you are employed by a hospital, health system, private practice, or community health center, institutional credentialing policies may impose physician collaboration or consultation requirements beyond what state law requires. Always review your employer's credentialing bylaws separately from state law. Institutional policies can mandate collaborations that New Hampshire does not — and your employment contract binds you to those policies regardless of legal independence.
